Javiel Pena Sola allegedly struck a vehicle carrying three people in Salisbury, North Carolina on July 18, according to Immigration and Customs Enforcement. Two victims died at the scene of the collision. Emergency responders airlifted the third victim to a nearby hospital, where that person later succumbed to injuries. A witness described hearing screams as bystanders pulled one victim from the wreckage. Police located Sola with assistance from a K-9 unit after discovering his vehicle abandoned in a creek.

Authorities charged Sola with three counts of hit-and-run involving serious injury or death. ICE has filed a detainer request with local law enforcement, asking officials to maintain custody of the suspect rather than release him on bond. The detainer would allow federal agents to take Sola into immigration custody following any criminal proceedings.
